Creator Program Terms

1. Intellectual Property & Trademarks

CHIOMA® is a federally registered trademark. All brand assets, including logos and product names, are the exclusive property of CHIOMA® Co.

  1. Mandatory Formatting: Our brand name and logo must always be displayed as CHIOMA® Co. Use of the USPTO trademark symbol (®) is required in all headings and first mentions.
  2. Usage Restrictions: You may not use any unapproved logos, modified marks, or branding that excludes the registered symbol. Your license to use these marks is limited and revocable at our discretion.

2. FDA Compliance & Health Claims

To protect the brand and ensure regulatory compliance, creators must strictly follow these phrasing guidelines:

  1. Prohibited Claims: You cannot claim that our products treat, cure, diagnose, or prevent any illness or medical condition.
  2. Approved Phrasing: Use supportive language such as "it supports...", "promotes...", or "it may help..." We encourage sharing your authentic personal experience.
  3. Mandatory Disclaimer: Any content discussing specific health benefits must include: "These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease."

3. Content Usage Rights

By tagging CHIOMA® Co. or using our affiliate links, you grant CHIOMA® Co. a non-exclusive, perpetual, worldwide right to repurpose, reshare, and use your content (photos/videos) across our social media, website, paid advertising, and email marketing. We will strive to provide creator credit whenever possible.

4. FTC Disclosure & Ethical Marketing

  1. Disclosures: You must clearly disclose your partnership. Use visible hashtags such as #ad, #chiomapartner, or #sponsored.
  2. Brand Alignment: Creators must not promote CHIOMA® Co. alongside content that is defamatory, obscene, promotes illegal activities, or provides medical advice

Paid Search & Advertising Restrictions

Creators are strictly prohibited from bidding on brand-related keywords (e.g., "CHIOMA", "CHIOMA Co", "CHIOMA reviews") on search engines like Google, Bing, or Yahoo. Commissions generated from unauthorized paid search traffic will be voided.

6. Commissions, Payouts & Coupon Sites

  1. Rate: 15% on net sales (excluding shipping, taxes, and returns).
  2. Cookie Window: 30 days.
  3. Payouts: Handled automatically via Shopify Collabs once the customer return window has passed.

7. Prohibited Search & Coupon Activity

  1. Paid Search: Creators are prohibited from bidding on brand-related keywords (e.g., "CHIOMA", "CHIOMA Co", "CHIOMA reviews") on search engines like Google, Bing, or Yahoo.
  2. Coupon Sites: Posting your affiliate code on third-party discount or coupon-aggregator sites is strictly prohibited.
  3. Penalty: Commissions generated from paid search or coupon sites will be voided, and the creator will be removed from the program.

8. Relationship of Parties

Participation in this program does not create an employment, partnership, or agency relationship. Creators operate as independent contractors and have no authority to bind CHIOMA® Co. to any legal agreements.

9. Right to Modify or Terminate

  1. Right to Modify: CHIOMA® Co. reserves the right to modify these terms at any time. Continued participation constitutes acceptance of updated terms.
  2. Termination: Failure to comply with branding or health claim guidelines will result in immediate removal from the program and forfeiture of pending commissions.

10. Program Eligibility & Conflict of Interest

  1. Exclusion: Current employees of CHIOMA® Co. are not eligible to participate in the CHIOMA® Wellness Collective affiliate program or earn commissions through Shopify Collabs.
  2. In-Store Conduct: To maintain our commitment to world-class customer service, the use of affiliate codes or referral links within the physical retail location is strictly prohibited.
  3. Self-Purchases: Commissions will not be paid on orders placed by the creator for their own use. Creators should use their designated staff or personal discounts for such purchases.
